Did I miss the part where the judge denied the merger because the price was too high? How is changing the terms (price) of the deal going to change the DOJ’s stance or the judge’s ruling?

Majority is 51%. Did you speak with around 2600 pilots? You can only speak for yourself and the 10 or 15 other pilots you spoke with. You are just hoping majority are against it. Not because you think so means it is so.

He shot down this merger agreement. A new agreement would start the process over.

THIS right here!! What is everyone even talking about? The media and the market is acting like there’s a reasonable chance this merger still goes through. How stupid do you need to be to actually invest money in Spirit based on the merger going through. Every time the appeal is mentioned (will/wont happen, expedited) Spirit’s stock moves. The deal is DOA, DONE, OVER. I think the judge is wrong, but that’s beside the point. Everyone needs to move on, this appeal is procedural at best.

It seems the only way at this merger could be saved is if Spirit could show they had serious solvency issues. Like Chapter 11 was imminent or possibly worse. Aside from that, the Judge made his ruling. Highly unlikely that's getting overturned. Honestly, I'm not sure why Spirit's balance sheet wasn't more of a focus in this trial. They're sinking. The ULCC model is struggling. No guarantee they even exist, let alone keep the ULCC model. They seems like that should have been an area of focus during the trial. Kill the merger...even more people will be harmed. I don't think JB has the greatest attorneys.
