Under the RLA, the Company, and court can move to invalidate part of the Award. Normally this would invalditate the entire arbitration award, unless the company and pilots represenative mutually agree that the Invalid parts are seprerable.

There is precendent (not in airlines yet) in which companies have serperated Award fences and position locks as an undue burdon to the company. If it's not done this way, than the entire award becomes invalid the JCBA requires the pilot groups to be merged to one list, and The RLA requires status quo until that happens. (no group can be reduced more so than another).

Out of senortity displacements / furloughs has recent precendent in court. It would be a tough battle to reverse the courts decession on out of senority furghloughs.

9l ticket is prob. getting sold anyways, so hopefully it doesn't matter. (I've not got a dog here anymore - I'm out )

Be careful how you read into what they said on the conference call. They said their "intent" was to abide by the JCBA. My "intent" was to get 1000 hours of TPIC time. Now my intent is to stay out of bankruptcy myself after the furloughs. Anything can happen from here.

Plan for the worst and hopefully you will end up somewhere above "worse".

In this industry, expect a 5h!t sandwich. If you get something better, thats icing on the cake.

Sorry for all who are affected by this BK. Hopefully we will all end up on our feet. If not, those that do, help the ones that didn't.

My $.02

This is a 100% bull! Abide by the contract? Didn't you already hear that in Day 1 of BK court the company announced that if ALPA and the Company can not come to an "agreement" on a modified contract, they would ask the court to throw out the JCBA? So much for abiding by the JCBA.

The company will give ALPA a list of "cost saving" measures to help the company. It will be a list of measures that slashes our already barely industry average contract. The company will then say "Take this or we will ask the court to throw out your contract."

Pinnacle Management can give a crap about our JCBA or following it. Heck, they havent followed it the last year while out of BK, why would they follow it now?
