I agree, it's not as bad as it first appeared upon reading the email. Though, if you don't have the knowledge on how to set something up as this, or not willing to consult your tax accountant prior to doing it, than you should leave it for someone else to do. I didn't donate to have 20% of my donation go to possibly paying his potential tax burden. It was meant for the family.
In the rush to help out, people probably should've taken a deep breath, figured out all the implications and then taken the best course of action. 'Course, that's all hindsight and I have to truly believe everyone had best intentions.
