Quote: I'm saying there is no predicting what a jury will do, even when presented common sense evidence.

OJ murdered those two people. A jury said he didn't.

Juries can, and DO, glom onto tangental bits of arguments, and use them as justification to render lame verdicts. Anybody think OJ didn't do it? Other than the 12 jurists, I mean.... The TWA MEC, with urine running down their pants legs, made the call...and now claim "information was withheld". Yeah...and the glove didn't fit.

AA should have let TWA go Chapter 7. Same number of "victims", but no lawsuit. The TWA plaintiffs spilled hot coffee in their laps, and sued McDonalds.
Don't you just love hearing from ALPA's best and brightest. Karnak has always been a true believer and launches Jihad against anyone who dares speak against ALPA. And this is what the ALPA talking points has sunk to. Equating this to the OJ verdict. Brilliant.

Please continue to make your pro-ALPA case Karnak. You're doing great.

There's "claiming information was withheld" ...and there is willful destruction of thousands of emails, the computers and hard drives of the parties involved and the destruction of the servers and backup files. That's WILLFULL destruction to cover your six.

ALPA almost got away with it. Sadly, they missed one computer. And the information was there, validating the claims of the TWA pilots.

This isn't an issue of AA letting them go bankrupt. This is a matter of a union that did not provide fair representation to their members.

Why would they do it? Dues money. If the deal was cut to the benefit of APA, then maybe down the road, they'd rejoin ALPA...at least that's what they SAID they'd do...and for ALPA, it was pure economics. Throw the TWA guys under the bus for a larger prize.

The politically elected officials will take the hit for this. The real fault...and guilt...lie with the General Manager who refused to join the union when he began working there, the Organizing department employee who sold his soul and then got caught destroying emails, and the lawyers who advised on this course of action. All of whom get big salaries while pilots have taken hits, all whom have nice retirement packages while pilots try to keep their bills paid.

Karnak is right about one thing...in this case a jury was presented with common sense arguments and facts. They didn't buy into the tap dance from ALPA. And the history of a great union is stained yet again by people whose arrogance in lying to the elected leadership was and is limitless, even in the face of being unmasked for the traitors to our profession that they are.

The very profession that has made them and their families very comfortable while those in the profession have suffered.

For those of you that think professional pilots would be better off without ALPA (warts and all), and think that we operate in a level playing field with the Air Transport Association (union of managements), I just wonder what row your seat is in?
Speaking of which seat, how much of the money Delta pilots sent DALPA and DALPA sent to ALPA will be paid to TWA pilots?

I ask only out of curiosity because what ALPA did will cost us all a lot but the TWA pilots deserve every dime they're awarded. It is simply atrocious that happened and the pilots deserved better and should be rewarded in full.

In honor of TWA:

In honor of TWA:

If this ends up forcing an assessment on all ALPA pilots... the DPA won't even have to try.

I love irony.

The McDonald's Coffee case is an amazingly apt metaphor for what occurred at TWA. Unfortunately, the metaphor is 180 degrees (no pun intended) opposite of the point Mr. Karnak thought he was making.

Here is what really happened:

Mr. Karnak, before you try to make a point you really should research the history and facts you attempt to apply in favor of your position. Your credibility will suffer much less if your example supports rather than refutes your argument.

That is true. If damages come down hard, they won't have to try it will happen on its own.

Quote: No they can't. You can be a paying non-member. There were over a thousand US Airways pilots with this status prior to them de-certifying ALPA. There were a few ex-Western pilots flying at Delta with this status.

If you are a non-ALPA pilot because you are grandfathered in, that's one thing.

If you are a non-ALPA pilot because your pilot group throws ALPA out the door, that's one thing.

However - if you, as an individual pilot, refuse to pay your ALPA assessments, ALPA can place you in "poor standing" and eventually require the company to terminate you. Naturally, ALPA will not represent you at your termination hearing. It will not happen overnight, but it can happen if the LEC wants to force the issue.

Quote: I would be shocked if it went anywhere. The TWA pilots made the choice they made. I guess ALPA could have tried to force them to not agree with the demands of the AA pilots to complete the merger but then its highly likely TWA would have shutdown.

Ahhhhhh......the memories.
