Anyone who thinks this ruling will pass constitutional muster, specifically strict scrutiny analysis, has their head in the sand. Injunctive relief in 3...2...

Count me as having my head in the sand. As long as NY denies access to their database, I don’t see NYers getting/renewing Global Entry.

Idk. Is global entry or expedited security processing in one of the amendments?

DHS dictates the requirements. States such as NY either play ball to participate or accept not being allowed to use the program.

Pretty simple and hardly an infringement on the constitution.

Injunctive relief on what grounds? 3 2...yada yada yada.

I had to apply for my global entry just like everyone else. it's all about data base access, and data base scrubbing. You can't have expedited entry unless the FEDS have complete and total access to all of your background information.

If a state is shielding information and preventing federal access for a federal program then the state essentially has decided to suspend the program. A "US State" isn't going to be able to force the Federal Government to have one set of rules for sanctuary states and another entirely separate set for non sanctuary states.

This won’t last long. Already a federal lawsuit. You can’t punish a states residents for the policy’s of a government.

You absolutely can, welcome to the law of unintended consequences. Zero constitutional freedoms have been violated, you’re free to come and go as you please. You just don’t get access to the speedy checkout lane

This brought to you by the same politicians that want to legalize pooping in public.
