Not so sure access to Trusted Traveler programs is a fundamental right nor are NY'ers a suspect class so that will make any argument that a court needs to apply a strict scrutiny analysis a pretty difficult hurdle. As for the Commerce Clause, who is going to invoke it? New York State? That would be a novel legal argument (usually used by the Feds against state laws) to get the Feds to lift the ban but I'm not sure how you prevail on that one. NY'ers aren't being banned from returning to the country, they just don't get expedited screening which would likely be found to be a de minimus impact on interstate commerce.

I agree with you that there is a scrubbing but I'm not so sure Benito Cuomo prevails on any of this. However, he would be way out on a limb denying access to DHS for those who have already established eligibility for TTPs. There is no need to grant sanctuary to those who have already established they are lawful citizens/aliens which, presumably, is done during your initial application. A denial of access to criminal databases for the renewal individual would run counter to the purpose of their purported sanctuary laws.
I get it. joe blow from Michigan wants to fight extradition to Florida. But, that's state to state. At the end of the day, Joe blow loses that fight. But, NY thinks they have a right to deny extradition to the federal authorities. Nuts! Whe heck let the nuts run the asylum over there?
The immigration laws and all of our federal laws should be enforced. The states and the local authorities are a piece of that puzzle. Furthermore, they all took an oath. It absolutely disgusts me that this arrogant childish behavior is tolerated in NY. You get what you vote for over there.
NY and CA will end up losing some big law suits in the near future. When unlawful foreign nationals (illegal aliens) commit crimes and they should have been deported, those cities that let them go will be on the hook for their damages. These data-base scrubs are important to insure criminals get processed as well as get their due process.

In other words, its just ANOTHER abuse of power quid pro quo. But since the Senate acquitted him in the Ukraine deal, he's free to abuse the power of the Presidency as often as he likes.
Remember the Checks and Balances theory you learned about in 5th grade civices? The Senate just wiped that slate clean.
