Take another look at the Airbus training letter. It's bass-ackwards from what the CBA dictates. The junior pilots being excessed from SFS to HKG should be training first. That's not the case.

Anyone know any good labor attorneys?

The way I read it:

If you bid to relieve excess you train in seniority order with everyone else into the new base.

If you are excessed you train in reverse seniority order out of the old base.

The priority goes to the most senior dude bidding into the new base regardless of excess.

I could be wrong.

I hope this question has not been answered elsewhere, but I find it strange and possibly against the contract for an 757 CDG FO to move to Honk Kong CP WITHOUT being awarded the seat.

She just shows up on the Posting 200802 Percentiles and not on the Posting 200802 Practice Bid awards. She was awarded CDG FO in Posting 200703 Final Award and now has just magically appeared on the 200802 Percentiles as a CP with Albie, but WITHOUT being awarded the in the bid.

How can this be? Is there something I am missing in the contract, hidden LOA back door deals or is the computer just now working correctly?

If HKG CA was #2 on someone's list, they have been denied that position wrongfully. They should have been awarded HKG CA when CDG was canceled. They are due passover if the company doesn't sent them, too.

Maybe I'm reading everything wrong, but that is my take on it.

Not sure what the legal answer is here.

Default subic pilot

You didn't do enough looking. The pilot in question is presently Subic based. On the 07-03 bid the pilot could have held HKG Captain. When CDG was cancelled, the FCIF said the cancelled pilots' awards would revert to what they could have held on the 07-03 award.

Again...most of us don't know the contract in and out perfectly or where the grey areas are. I urge you if have questions to contact the ALPA MEC office and chat with Terry McTigue or Eric Iverson. Not only will you get a straight answer, they will probably be glad to have someone on the phone other than me!

Seriously--they work for you, and they are a great asset. If you have questions don't hesitate to ask the experts.

You should read CBA section 24.E.4.

Cancellation of Awards
a. The Company may cancel an award/assignment of a crew
position in reverse seniority order provided it does so at
least 30 days prior to the pilot’s scheduled training date.
A pilot whose award/assignment is canceled may either
remain in his current crew position, or exercise his seniority
for an award or a vacancy posting that occurred between
the date his crew position was awarded and the date it was
canceled. ......

The Pilots awarded CDG in posting 07-03 are not being excessed. Their award was cancelled. This is a horse of a different color, so to speak.
