The concept of "past practice" is for items not delineated in the PWA.

They were smart to do it before initiation of contract talks. I'll be honest, I'm not smart on status quo violations, but it sure seems like if they had done it after talks started, it could have been an issue.

I mean, the PWA says what it says, whether we like it or not. We certainly claim the sanctity of PWA language when it benefits us. Two can play that game. I think the company can easily play the "past practice" game and compare rates of Auto Accept usage now vs two years ago. You get the idea.
A past practice is just that. No need to over think it. That's a legal interpretation as well. Same simple words.

Would the fact the company tried to get rid of PB days last contract go far to argue it was standing practice to allow washing? Otherwise why would they waste negotiating capital when they could've just yanked the mutual agreement?
