My 2 cents on why I think trip parking IS illegal: The parker never truly lost possession of the trip, just found a way to make it temporarily disappear from his line.

Let's say you were suing person X. X calls me and asks to sign some assets over to me until this lawsuit clears up, then give them all back. If the scheme were discovered, wouldn't the judge consider those assets to always have belonged to X?

I don't think ALPA is endorsing it, but they've been told it's going on and they're ignoring it. I told them several years ago, and they told me to bring them proof. Problem is that we as individuals can't track most of the transactions involved. ALPA can, they just ignore it.

Can we move beyond calling an alleged "breach of contract" , "illegal" ?

No laws have been broken, no pilot has been convicted, nothing here is "illegal."

Definition of ILLEGAL

: not according to or authorized by law : unlawful, illicit; also : not sanctioned by official rules (as of a game)

It seems to me, and I won't put words in their mouth, but those who are big ALPA fans here seem to be against trip parking. My guess is so is DALPA but it's not in violation of the contract but rather one of those things that will be fixed in a LOA or MOU when the company needs something in return.

Two can play this game:

"The Middle East is obviously an issue that has plagued the region for centuries."

"The reforms we seek would bring greater competition, choice, savings and inefficiencies to our health care system."

"No, no. I have been practicing...I bowled a 129. It's like -- it was like Special Olympics, or something."

"What I was suggesting -- you're absolutely right that John McCain has not talked about my Muslim faith..."

"Let me be absolutely clear. Israel is a strong friend of Israel's."

"On this Memorial Day, as our nation honors its unbroken line of fallen heroes -- and I see many of them in the audience here today -- our sense of patriotism is particularly strong."

"I've now been in 57 states -- I think one left to go."

^^^^^^

That said, I think there is something about being in the public that makes you gaffe prone. Nobody else is talking but you, so you need to fill dead air and you just keep talking because there is nothing worse than silence.

But Joe? He doesn't count. Not even the President thinks he gets a pass.

Hey, leave my buddy Joe out of this.

Vice President Biden ditched a day of presiding over the Senate to "give the twin cannons some sun."

WASHINGTON—Taking advantage of the warm spring weather Monday, Vice President Joe Biden parked his 1981 Trans Am in the White House driveway, removed his undershirt, and spent a leisurely afternoon washing the muscle car and drinking beer.

"This baby just needs a little scrub down," said Biden, addressing a tour group as he tucked the sweat-covered top into the belt loop of his cutoff jean shorts. "Gotta get her looking good so I can impress the chicks when I'm cruising down Pennsylvania [Avenue]."

White House aides said that Biden pulled into the driveway shortly before noon, the chorus of Night Ranger's "(You Can Still) Rock In America" blaring from his car's stereo. According to witnesses, Biden spent several minutes maneuvering the Trans Am into the perfect spot, and was observed drumming his fingers on the steering wheel until the song came to a close.

The shirtless 66-year-old then entered the executive residence and greeted employees with a round of high fives and a variety of nicknames. "Hey, hot stuff, looking good," Biden told a passing aide. "Would you know where I could get a little bucket and sponge action? My mean machine needs to be cleaned."

I think with regard to trip parking, the way to look at it is: Is trip parking illegal concerted activity?

The company looks the other way because it is not expensive and may save manpower. DALPA, initially vocal about it, seems silent. Is it because it has not affected jobs? Yet?

Turn the tables. If a whole small category got together (but only acted as onesy and twosy) and had a sickout/ greenslip campaign in which one person said to another "If you sick out, I will greenslip your trip." Then multiply this across the entire small category where this happened with everyone.

Would the company be up in arms? Would DALPA have to take action? Is there REALLY a difference between trip parking and sickout/greenslip? (beside the pay for trip.)

Just asking, not advocating.

You mean, a conspiracy!

Edited ... Check Essential's post changed my opinion. The onion remains.

Does the company have data showing how many trip parking events have occurred and would ALPA have access to it if they did?

The contract sets an ALV. (22.C.1 Note 2)
The contract sets a pick-up limit of ALV +15. (23.P.7.a)
The contract says the Pilot to Pilot Swap Board can't be used if the transaction would create or be within one hour of creating an FAR or PWA conflict. (23.F.7.b)

How does the company (and ALPA!!) ignore that language?
How is it not a violation?

The max pick-up rule has a long history on this property. It has always been accepted and explained by saying "the contract protects us from the company AND FROM OURSELVES."

I think that principle was too casually abandoned by ALPA when the "Swap Board" was created and trip parking somehow got endorsed as a way to get around the contractual pick up limit.
That sounds good. I say, "file it!" You could probably get some others on board for a group grievance. With the Company's recent staffing decisions and statements that we're planning to adjust flying below demand my guess is that the 2012 capacity adjustments are going to be disappointing. Anything that helps keep more pilots employed (especialy while the Co. is making money) is a good thing.
