I think it a violation of the intent… The companies favorite word!

A long time ago, I had a AA deadhead cancel from Ottawa. When I asked them to revise to a legal deadhead, CRS says I see you booked a ticket back. I said so, I haven’t deviated in VIPS. Well, where are you? I said Detroit. So the response was so you intend to deviate? So I called CE (back when they would actually answer) and David said he agreed because I was intending to deviate by booking the tickets. So yes I think calling me outside my notification window is a violation of the intent. Just like the told me to pack sand because of my intent.

I agree there is no actual words that were violated. But there are lots of holes in the contract that fall on intent and status quo. And it is up to OUR Union to challenge the company to clarify, codify and grieve as required.

I understand where you are coming from, I just don't see where the union could grieve this. Just because you think that is the intent doesn't mean that was the intent of the language when the NC agreed to it. The union needs something in writing to show intent. Kind of like lay flat seats. The union said that they had documentation showing the intent of the language, but when it came time for the grievance, that documentation didn't exist. We lost. I have done the same thing as you when it comes to back end deviations. I have never had them say that because I purchased a ticket without deviating, I intended to deviate. I have told them that we don't have 8 hours of scheduled rest for the back end deadhead and they need to make the pairing legal. No issue. If there was and the union backed the company, I would have grieved it on my own. You don't have to have the unions permission to grieve something.

I’m not looking to grieve it.. A call back or reply to the dart would have been nice…. Maybe something along the lines “Thanks for contacting us, we called CRS and told them to stop the shady calls”. I’m just listing a couple of (my own) real world examples of the lack of communication and Contract Enforcement. Basically, in regards to original post, don’t be surprised when they don’t care!

A call outside the notification window is a plus in numerous situations. Especially for commuters like myself on day 1 of reserve. Listen to VM and get assigned a dhd and then you can deviate and not go to domicile.

If you are on reserve, please understand fully 25.M and your responsibilities with respect to availability, reserve periods, and legal assignments. If you have questions, ask someone. We can only defend our contract if we understand it well. Please, some of the responses in this thread are troubling to say the very least.

Here is my process if Crew Scheduling calls when i am not required to answer. I don’t answer listen to the message if it’s in your favor call back. If you accidentally answer or it’s a unknown number as soon as they say Captain I hang up the phone and follow rule one

Such a simple concept yet many can’t figure it out. The ALPA pocket calendar even has an easy to read grid.

The ALPA doc on Whitlow ruling is also a must read for reserves.

I've had this bite me before. They did a bait and switch with the voicemail. Just FYI there are schedulers who will do what has to be done to get that terrible trip filled.

And apparently no work doesn’t have a problem with this cause it benefits him as a commuter!
