A company is not required to give FMLA until the employee has worked there for 12 months. Other airlines cover this in their CBAs to allow for medical leave prior to 12 months employment, but I’m not aware of F9 having a contract provision for it.

I concur. Even in other sectors where all employment is at will, it is illegal for dismissal solely based on calling in sick.

Not getting a doctor’s note if required, not calling in, calling in sick when someone found you were out on your boat having fun, coordinated sick outs, excessive sick leave abuse/use. All those are legitimate reasons for dismissal.

There are employer that fire employees for sick leave within guidelines. There are plenty of court cases that require reinstatement of those employees with back pay.

The burden of proof rests on the fired employee to prove the company fired solely based on calling sick. The company doesn't have to prove anything. Not giving any reason is a legitimate reason for dismissal. It blows my mind.....

Not to mention that a bunch of letters were sent out to non probationary pilots for having accumulated 20 sick days in 12 months. There is nothing in our contract that puts a cap on how many sick days we can take in a year.

I hope everyone that received this letter and the probationary pilots all get the FAA involved because ALPA has done nothing to push back against the company except saying they are aware of things and are looking at every angle!

The company can do whatever they want whether it’s legal or not there is just ramifications for their actions. They couldn’t care less if it comes back on them later because they got to stick it to the pilots now. It crazy working for a company knowing management despises you but also needs you to run their airline. Apps updated a contract can’t fix culture.

They should have at least had a meeting first. To warn the individual. Not just can them like that.
