It was contractual per the merger agreement. Frontier even cited paragraph and section in their letter.

I would normally agree, but they already have the data to know it will fail, so that don't need proof of the need for a better offer.

I read somewhere that this current F9 offer wasn't really any better, something about the shareholders paying in essence the additional $2 bucks per share that they offered. Nothing in cash was added while B6 upped the cash. So I don't see F9 doing anything.....hopefully

The F9 CEO literally said they made their last/best offer and if NK decided to go with B6 they would waive their right to match. I think at this point they want the $100M breakup fee and Spirit brand out of the way and see what they can do alone.

Exactly! They’re taking on debt to pay for the extra $2 per share. In theory that debt would have a negative effect of $2 share on your stock payment. They just rearranged the 2 piles of payment. Share price goes down, cash offer goes up, same total value as before.

Take the $92m break up fee and then see if the JBLU fails DOJ and they can see if they want to try NK again at that time.

Won't be an option. DOJ will not stop the acquisition. JB will negotiate and get Schumer involved at whatever level to ensure this goes through.

If the NK BOD believed for a second that the DOJ WAS going to block a B6 sale, they’d agree to it, pay F9 the $92m breakup fee, and then more than make it back with the B6 DOJ penalty fee and be $300m ahead of the game.

But the NK BOD excuses aren’t clicking with the shareholders and they are slowly resigning themselves to the fact that those sweetheart deals with F9 are gone for good.

All I can say is of course we're all sick of this B's not b6. I assume f9 has something in the bank ready to fire. I also assume that b6 does as well. The enemy is the mgmt group that delays this for no reason, shuts down pilot bases without warning, potentially displaces pilots and put them all in FLL. Just give me an answer so I can update my apps if Bill and Ted gets his way
