As to the lawsuit, it is still in its infancy. It was filed in Feb 2018, so figure at least a year of discovery and motion practice. If her claims survive that, then trial maybe mid-2019 at the earliest? That assumes there isn't a settlement in the meantime.

I don’t know exactly what causes it. Low blood sugar or low tolerance. But, my girlfriend can’t drink like she used to. And, she goes from what appears to be perfectly fine to, “Holy fck-What did you take?” in mere minutes.
In this state I would be afraid to leave her unattended. At times I’ve even considered making the 911 call.
All this on like three quick glasses of wine. Which clocks in at around 3/4 of a bottle.
For a girl that weighs a buck ten it hits her quick.

So you don't have any questions about the timeline of the night in question? You don't have questions of the contents and time of the call to ALPA? No questions of why a drugged and raped woman would call ALPA from the rapists room before going back to her room? You don't have questions how someone who had just awoken from a drugged state could remember what the CA said about the voicemail from the FODO? No questions about the FA that saw him WALKING down the hall with a girl and two glasses of wine at sometime before 10:47?

Not saying you're mistaken, but what is "drunk"? I think we can all agree that if you're passed out unconscious, then yes, you can't reasonably be considers to have consented to anything and any sexual activity would be rape, first degree sexual assault, or whatever applicable crime. (I'm not trying to equivocate here, the laws vary from place to place. Alaska, for example, no longer has the crime of "rape". What normally is considered "rape" would be first degree sexual assault in Alaska) The thing is, it's not a binary situation in when you're either passed out drunk or stone cold sober, there's a continuum of intoxication. (yeah, I know: thank you captain obvious. ) So at what point does it legally transition from "making poor choices" to ""not legally able to give consent" ? How do you determine that? What happens when a man and a woman at similar levels of intoxication have consensual sex? Did he rape her or did she rape (commit first degree sexual assault against, whatever) him?
But there are also things like the Washington State Law about sexual harassment in the workplace, that attempts to put the same sort of constraints on people in supervisory positions playing around with subordinates that have been placed upon teacher/student and other unequal relationships, which happens to be the mechanism by which the FO is suing the company.
Legally, this has become somewhat of a minefield in many states and it's time everybody realized that the "coffee, tea, or me," days are long gone. Most people have worked too long and hard to get to where they are to want to risk putting themselves in this position. Well, most prudent people anyway.

I suspect the defendant will go to great lengths to avoid a public trial on this particular topic at this particular moment in time. Discovery process will just fine-tune the number of zeros on the check. Only prudent, the publicity would likely cost more than a settlement.
Plaintiff: These are horrible facts for you, you can't have this publicity, and you will get creamed at trial. I have you over a barrel, so get out your checkbook.
Defendant: We are going to wear you down and outspend you with discovery and motions. We will put your character on trial and we will destroy you in the end. If the checkbook ever comes out, it will have very few zeros.

Well, that's fine if you aren't drunk. People tend to lose their good judgment when they drink. I'm getting a little tired of the man always being expected to be able to exercise good judgment and women getting a pass. Perhaps not drinking is the only way to rid our society of these he said she said cases. Didn't we try that in the last century?

Since they were scheduled to fly 10-12 hours later, I don't think the CA was that drunk that he couldn't exercise good judgment.
