Help me with this one. Skymark only flies inside Japan and the Section in the contract applies to 5th freedom flights FROM Japan to NOT Japan. If Skymark only flies inside Japan what's the concern as they don't do 5th freedom flying?

As of January 2013, Skymark Airlines operates scheduled flights to the following destinations:
Amami – Amami Airport (seasonal)
Asahikawa – Asahikawa Airport
Fukuoka – Fukuoka Airport Base
Ibaraki – Ibaraki Airport
Ishigaki - New Ishigaki Airport
Kagoshima – Kagoshima Airport
Kitakyushu – Kitakyushu Airport
Kobe – Kobe Airport Base
Kumamoto – Kumamoto Airport
Nagasaki – Nagasaki Airport
Naha – Naha Airport Base
Sapporo – New Chitose Airport Base
Tokyo
Haneda Airport Base
Narita International Airport Base

Talked to my Rep and he said that Delta does not have a code share with Skymark, and as far as anyone knows there is no plan for it today. Even if they did, he noted that if they flew outside of Japan and not to the US or a US Territory with our code on it, it is Fifth Freedom Code Share flying and would be part of what would be lost if they go below the hard block hour floor.

He also said that the negotiators are hard at work on a Negotiator's Notepad that may read like a short novel.

The current language says 5th Freedom between Japan and Asia. The A380 (delivery August 2014) is going to JFK and LHR if they get route authority. That's not 5th freedom FROM Japan TO Asia...?

I get that. However, it appears that we disagree on how to get to he next level. Maybe this will be a good test. Let's say no, tell the company to pack sand and see what happens.

And it is never to early to invest, and you never make to little. (Jim Cramer did it while living in the back of his car) It is a certainty that even the most junior guy on the property can stick a few dollars into a good growth fund. If he can't he really needs to reconsider his priorities. JMHO
