My input on venting was so this thread would not make a bad turn as some threads have done very quickly. It has been and continues to be professional. I don't feel you slammed anyone. I wish you the best of luck and speedy return for you and all of us at least this may give us options. Snacks and Thunder1 good luck. My paperwork was in at end of Mar.

I hear you, I don't want this thread to degrade. I thought that I was ahead of the curve, had all my paperwork done well before this new program started. But to be honest, I think that I'm now caught up in AFRC confusion with the new program and I fear that you all will maybe see the same thing.
As a reservist, are you active duty guys used to getting PCS orders only a week prior? Come Monday I have a lot of phone calls to make.
Personally, I should have made some contact with my Command earlier, I thought things would naturally happen.
Yea, so I'm frustrated. But as you all said, I couldn't feel more fortunate to have this too. (Explaining this buffoonery to my wife is the hardest thing).

I scanned all 22 pages of this thread rather quickly and may have missed it if already addressed.
Nutshell:
I'm a Traditional Reservist; O-5. Next year I face mandatory retirement for 28 years since commisioning. I'm very tempted to come back as an AD. I'd be interested in continuing to do what I do---T-38s--although T-6s and T-1s are in my local area and would not require commuting.
I doubt they'd want to put me in a front-line fighter, but would consider it if offered. Well hell, I'd fly QF-4s at Tyndall if they let me.
The question: if I was on, say, a four-year contract, could they deploy me on a 179-day good-deal to Balad or Kirkuk, or as a 'Retiree,' are they only using you for a specific non-deployable job?
And finally, an opinion: I don't think USERRA applies to any of this, because USERRA is only for the part-time Guard and Reserve. If you volunteer to go active-duty (as opposed to being recalled in a mobilization), I don't think you are covered.
I asked United about this and they said I would have to take a personal leave of absence, so they seem to support that view.
If anyone knows the policy for deployments, I'd appreciate the info. Note: just found the link to AFPC, so the deployment answer is "yes." I guess the question for me now is: who are the likely choices for non-vol 179-day rotations? I'm not averse to combat and have done plenty of time in the sandbox...which is why I don't really feel like spending any more time over there.

You might want to double check with your USERRA reps in the union. From what I was told, it doesn't matter whether you volunteer or not to go back to AD. USERRA still covers you. That's what I was told at least. Take it for what it's worth but I'm pretty sure you're still covered. Somebody can correct me if I'm wrong and if you find anything else out, please let me know as well!

Whomever you talked to at UAL is wrong in my opinion. With an all volunteer service we need a lot more E-1s thru E-4s and O-1s thru O-2's. USERRA allows you to leave your job and perform military service for a period of time not to exceed 5 years. USERRA is intended for "non-career" military service. A lot of people believe that USERRA is just for the Guard and Reserve because we are the ones who use it most often.
There are some exceptions to the 5 year rule, but that's another topic.
As I've said before, I'm no where near an expert at this USERRA stuff, I've just done a lot of reading.

For those Guard/Reserve folks you guys have an added step to go through to come back on active duty. For us retired AD guys we have filed our papework directly to AFPC. Once at AFPC is has been frustrating at the pace for all of our paperwork, we all hope is gets stream lined for the future.
My observations on Reserve guys coming back on active duty and effect on there airline status. Not sure if this helps, after 911 I knew several folks who came back on active duty after being furloughed or about to be furloughed. While in furlough status there 5 year time limit did not apply. It only applied once the company asked them to come back and could not defer any longer. That is when they started the "military leave" option and there 5 year limit. For example many guys at AA will be away more then 5 years total but less then 5 year on military leave. Also not all these guys were in postions that deployed. For example some were teaching in AETC.

I haven't heard this addressed specifically, but I've had some recent experience dealing with mandatory separation dates and I'd be very surprised if you were allowed to continue beyond an MSD in any capacity. I tried very hard to get one of my guys continued beyond MSD and was told that it was impossible. Maybe the retired recall program makes some change to that, but I can't find it. Good luck.
