Why scapegoat? The individual had access to engineering, chain of command, his chief pilot, and company management. Wouldn’t it have been his duty and responsibility to report concerns, if any, to the FAA, even if addressed by Boeing?

...and while we're fixing things, how about the title of this thread? As the actual article is spells out, he was a Boeing pilot when all this went down.

Come on. Let’s not pretend that there’s not at least some smoke here. After misleading/obfuscating the facts about MCAS to the FAA in order to not require airlines to provide additional Max training to their pilots, he gets hired by the one airline that stands the most to benefit from there being no training. Then when he gets hired, SWA rewards him by making him a NOC Chief Pilot (as an FO).

Kind of reminds me of the Boeing/Darleen Drunyun fiasco. But in that one, nobody died.

Don't think he was a NOC CP. He did work under the Dallas CPO and probably worked as an ACP of sorts...perhaps you've got more inside baseball knowledge than I, but his board specifically said DAL CP. Is that the same as NOC CP? He also hardly flew, never had any type of office pulls on his board, and when he did fly it was frequently up to SEA/PAE/BFI

My opinion how this goes

He gets indicted by Grand Jury
He is offered plea deal to testify against Boeing senior officials and connect some dots
Agrees and charges dismissed
Does not cooperate and gets full sausage

He was a project pilot making 115 TFP at his current payrate and longevity. He could not hold a captain seat and was not qualified to be a NOC chief. He did not fly the line. His Boeing and FAA connections undoubtedly helped him get hired, why wouldn't they?
He wisely took the VSP, I am sure under the advice of management and legal.
I don't know the guy, but you can bet the feds and Boeing were looking for a convenient scapegoat. Looks like they found one. It's perfect. There's damning texts, he isn't rich or powerful, and he wasn't high up enough at Boeing to imply some sort of fault may lie with upper management.

yup. Fully agreed. He was high up enough to be the conduit to the FAA and low enough not to bring down Boeing.

“That agreement with Boeing, while clearly laying out a case for charges against Forkner, was criticized for the way it explicitly exonerates Boeing’s leadership. The case was brought by the then U.S. Attorney in the northern district of Texas, Erin Nealy Cox.

Cox left the Department of Justice after the agreement and in June joined Kirkland & Ellis, Boeing’s lead corporate criminal defense law firm. On Kirkland’s website, she was welcomed to the firm as a partner by Mark Filip, who had signed the Deferred Prosecution Agreement on behalf of Boeing.”

WTF, I really think Forkner deserves time, but holy corruption!!!

For being a sarcastic wise-ass with a co-worker? Using "cool" lingo while talking to the FAA? Lawyering up and pleading the 5th?

I know, I know... expecting pilots to be able to do that pilot ****** is racist.

Wanna hang someone, start much higher than Forkner.
