Attorneys can also be admitted to the Bar in a State on a temporary basis "pro hac vice" or "for this turn." To be clear, I have little doubt any law school graduate working for ALPA could be admitted under the right circumstance.

In reality, our MEC can get advice from any consultant they desire. But this political advice comes in a form that makes it appear to be authoritative legal advice. It would be good to clarify and distinguish the practice of law from the practice of politics.

I know you already know the answer, but the answer is that an ALPA national attorney would have to advise for the pilot's firing. To do anything else would be a breach of their duty to represent their client's best interest. Their client of course is ALPA national...not the line pilot. That individual pilot's defense is up to the "association", and even that duty is only to fairly represent. Not to represent like a pit bull.

That's why you always hire outside counsel with expertise in wrongful termination if you're ever faced with this. With ALPA representation, your fate hangs on whether your continued employment serves the interests of ALPA national.

Yes he really did. It's one of the weaknesses of our internal union politics. The latest example is going on at American Eagle with a local union official being threatened for his opinions. The threat came in the form of a photo and text message appearing to show him having a cocktail in uniform (because he just commuted in for the union meeting where the picture was taken). The text along with the picture said simply: "somebody sent this to me, thought you should know". It should serve to show all our union officials that evidence is collected on you...in case it's ever needed.

Yes it's pathetic, but it's what people do when they fear losing power.
