Everyone does realize that in order to be assessed, ALPA members in good standing have to APPROVE the assessment via vote? So they can't just TAKE $$$ from you. The assessment has to be put to vote.

OK Chuckles. From the Judge's order:

IT IS on this 4th day of May, 2012, ORDERED THAT:

(1) Defendants' Motions are hereby DENIED.

(2) Plaintiffs shall identify their damages expert(s) and serve all Rule 26(a) (2) disclosures that do not rely on the existence of an expert report by July 2, 2012.

(3) Plaintiff shall serve their dameges expert(s)' written report and all outstanding Rule 26(a) (2) disclosures by August 6, 2012.

(4) The parties shall appear in chambers for a scheduling conference on August 9, 2012 at 2:30 PM.

Yes Carl, it makes me chuckle. It's FAR from over. There still has to be a hearing for damages. Then they'll likely be appeals. These trials can take 10 years. Not to mention that DPA leaves out the fact that an assessment must be approved by a member vote. Instead, they choose to imply that ALPA will just swoop in and take $30,000 out of our checks.

Bingo. Once they lose the leverage, it's gone forever. They'll fight tooth and nail to keep it, even if it makes no direct financial sense.

Yes, how proud you must be of your beloved ALPA. They do the wrong thing, are found guilty by a jury, and have all motions to vacate DENIED by the judge. But do you write one sentence of regret for your beloved ALPA having done the wrong thing? Not a chance. Instead, brag about how your beloved ALPA can drag it out for 10 years. Do you even stop to think for a moment the moral high ground that ALPA loses when they behave every bit as badly as the most corrupt corporate sharks? Unreal.
