Actually, it's an arbitrator, not a mediator. And the question he's being asked to rule on is whether the "PBS Process Agreement" which was published in the failed TA is still in force or not. If not, the XJT MEC must negotiate with the ASA MEC to create a new one before they can continue with SmartPref. If he rules it is still in effect, nothing changes.

And there it is folks, for the whole world to see. Nevets and his MEC want to implement and negotiate SmartPref outside the JCBA? Why you might ask? Because SmartPref incorporates Globalization. A very crappy system that in a nutshell, a JUNIOR PILOT, by changing his bid, can mess up a Senior pilots bid. This Globalization feature is a huge chip for The Company and a massive cost savings. They want to buy the ASA pilots QOL with their SmartPref system so they can continue to fund their DC plan, OJI bank and a few others. It frees up enough money for them to do so. I'm glad that B.S. put out that letter today, he at least realizes what the company is up against, but you're not going to stem the tide of pilots leaving by saying "pretty please." No monetary reason, and promises of maybe upgrading next year ain't gonna cut it.

This is boiler plate language that existed in all of the prior CPAs xjt has had with cal/UAL. This language about termination rights, indemnification, breach, cause, commodity events, labor disputes, etc. is all standard. I know because I've read the CPAs.

Flame bait but I'm bored so I'll bite.

Why are you throwing me into this conversation? That's not even what Captain Tony said. The PBS process agreement had you keep flight line for the duration of the JCBA. My question is, what will you grieve next if you lose the current arbitration?

Thank you for admitting my MEC is trying to protect me and my pilot group. I don't know, what other QOL features are you and your MEC willing to sell my QOL down the river for your own gain? Question is, what else will you cry foul on when you lose? From what I'm told your neg chairman looked awfully bad on the stand.

He looks bad all the time. Not all of us are born with good looks.

Anyway, I never said your MEC was doing anything but. In fact, I've been saying all along that both MEC's are just looking out for the best interests of their pilots. But you guys seem to take that personally when the erj MEC doesn't want to give up our better contract just to appease your MEC. Why should we have to give up our things for you guys? If you had the better contract, I'd be telling my MEC to get us what you guys have and not be part of dragging you guys down to our level!

If we lose, then they negotiate something else. But if you lose, how much do you want to bet that your MEC will grieve something else in order to get out of their previously agreed PBS process agreement?
