This is America, man, go ahead and sue! While you're at it, ask for a couple million $$$ for pain and suffering.
But i'd direct your inquiries to ALPA Legal or an attorney. Asking your fellow pilots for advice (legal, financial, career, etc.) is just asking for trouble.

You won't give me "legal" advice? I wasn't asking you for legal advice. You guys are just laying down and accepting an unacceptable status quo with this "well, the company says...or that's the rules". Whatever, I thought this was a strong, united, don't take s@#t pilot group that had the cajones to go on strike for what's right. NY state has been giving me unemployment assistance because Comair furloughed me. Now, this same company will fire me because I can't show up when they snap their fingers??? What I'm saying is that I'm going to look into what our rights are as employees. This isn't right if the company does this. We've been talking about this for over a year. Let's figure this out!

...but while your at it, 4runner, try to get pay seniority accrual for furloughees too. It would be a great disincentive for the company to furlough more than absolutely needed...
I may not be a lawyer, (but I play one on tv), was always under the assumption that if you work under a CBA, your recourse is limited to the grievance process, unless it falls outside the guidelines of the RLA, (i.e. sexual harrassment)... Just a thought...

4Runner,,, you work for a company and they don't owe YOU anything, so if they call you back to go to work then you go, don't hide behind a certain organization and then complain that you are not getting what you want, quit if you can't take it so we who want to work will move up!!!!
I don't think it will fly. Morally right.....no, but then is anything at an airline morally right?
Don't get me wrong though,,, companies should treat people good and have a positive atmosphere and actually want the employee to produce for them, why managers think that the scare tactic works is out dated and does nothing but pi$$ people off... but still we are at the company for the company and that is anywhere you go, since I got furloughed I am doing computer work and its the same thing here...

Actually Turbo, you've got it backwards. "At Will" means a Company can discharge an employee for any or no reason. A union contract gives an employee the right to fight their discharge through the grievance and arbitration process. As a free people we are able to leave anytime we want.
4runner rolled the dice by signing an employment contract (which was very understandable) effectively betting he would not be called back before it expired. I understand 4runners frustration, but he has to take responsibility for his own actions.
