You answered your own question re. the LOA.

They have a choice...they just don't like the consequences. We'll wait and see how this plays out, but I think you're underestimating the ease of collecting LTD. I don't know if you work for UAL (your screen name leads me to believe you do), but we ALL pay for pilots on LTD so we all have a dog in the fight.

. Edit. I pay for my LTD. So do you. It’s no different than any other insurance scheme.

Good luck. You may have a dog but you have no say. I’d say the consequences will be what WE don’t like since we’re all going to be paying for a bunch of our coworkers who take the LTD.

As long as they are legally covered per their doctor nothing can be done. Ask the company how firing 11 people who got divorces to collect pensions went for them?

Yeah, but you left out the most important part...

"A Pilot is considered to be disabled under the LTD Plan if the Pilot is ineligible to exercise the privileges of the Airman Medical Certificate that the Company requires to operate in the Pilot’s bid position as the result of an injury or medical condition."

This is the same language in the expanded policy as well.

It doesn't mention your ability to maintain an FAA physical, just that you can or can't exercise your certificate as a result of that condition. If you received a medical RA and then the company no longer allows you to exercise your certificate in your BES, it certainly would seem to qualify to me. I'm assuming that the RAP was legitimate enough to only afford RAs to those with supported conditions, not just those who didn't want to get it for whatever reason. I have no idea how many of the people in that group were religious/medical RAs, so this is largely academic. There's likely so few of them that we may never actually know what happens.

Not wanting to get a vaccine isn't the same as not being able to. But I guess that's why we were talking about finding a doctor to rubber stamp refusal.

Meanwhile, Southwest just mandated the vaccine.

That part is irrelevant since they aren't ineligible to exercise their medical certificate. Has any pilot been able to collect LTD over the yellow fever vaccine? This is COMPANY policy - NOT FAA medical requirement.

It’s completely relevant. The company made a policy that makes them ineligible to exercise their certificate for a medical reason. It’s the language of the UPA verbatim.

I’m not aware of a pilot who was put on a unpaid leave who had a medical exemption for the yellow fever vaccine, are you?

The list of destinations requiring a yellow fever vaccine is very small and only affects a few pilots, while the list of restrictive countries due to covid affects every fleet.
