First, that injunction that has spooked DALPA for all these years was issued because we were in section 6 contract negotiations and the no overtime campaign disturbed the status quo. That is not the case now.

As to how I would legally put pressure on the company to negotiate-
Here's how:
The reserve section of our contract is in a state of flux right now. Since FAR 117 its pretty much null and void. The language no longer conforms with the law and regulations. Management responded to that situation by quickly issuing a memo that essentially dictated what our contract would be while the reserve rules were re-negotiated. In other industries and at other companies trying to unilaterally impose new work rules like that would be an act of war.

In fact, you want to talk about RLA violations? What Dickson did is arguably illegal under the Railway Labor Act.

§ 152 Part 7: No carrier, its officers, or agents shall change the rates of pay, rules, or working conditions of its employees, as a class, as embodied in agreements, except in the manner prescribed in such agreements or in section 156 of this title.

DALPA's response? We rolled right over and allowed them to do it. Our union's response was weak, pathetic and embarrassing.

If we were a real union we would have issued our own "memo" that would be every bit as legitimate as theirs under the Railway Labor Act.

I won't go into particulars of what I think our memo ought to say because I still think there's a chance that Donatelli might be the guy who will finally get this union up off its knees and put up a fight.

But there's your leverage. The pilots have the same rights as management in this situation. We just need to find the courage to assert those rights.

I didn't get unstacked and it gave me 3 5-days trips while awarding day trips to those junior to me. What gives? It even says "honored" in the reasons report to avoid pairings longer than 4 days, but it obviously didn't honor it.

Is line 3 an award or avoid? If it's an award, that's your problem. Call bid assist next month.

You are not the first and won't be the last. One month when I wanted Saturdays off I bid "Prefer" duty on Saturday instead of "Avoid." Unfortunately my bid was 'honored" every weekend. :p The good point of this story is that the rest of my qualifiers were able to at least have me fly descent trips over the weekend.

Got to go make sure my house is not on fire, for those who don't live in SOCAL, San Diego county is pretty much on fire. :eek:
