You live in a mighty big glass house. You have a long track record of insulting, name calling, berating, etc... your fellow co-workers on this forum. Several on this forum constantly suck up to you to stay out of your crosshairs.

OK then... you aren't angry, you just hate ALPA. Your posts are completely misunderstood. And I see zero evidence that anyone "sucks up" to me. If there is anybody that is doing that, I urge them to send me a PM and call me out. I am a big boy and I can handle it. I have nothing but the utmost respect and admiration for those I work with... except those of you that would rather burn the place down than work to make it better. Operative word here is "work". All you ever do is thump chest and berate those that are working hard for your interests, because the wheel doesn't move fast enough to suit you. Keep throwing your grenades from the ether, and I'll continue to call you out as being what you so obviously are.

Take a look at the United case to see how the Court evaluates the criteria you listed. It starts on page 80 and continues to the end of the decision (page 85).

If you want to see how the Court would most likely treat the evidence Delta would use to establish that we were the cause of their cancelled flights, take a look at page 31.

Finally, take a look at the duty the Court feels the RLA imposes on ALPA. (page 63).

Read the case law, which you asked for, that I presented. You will see that I didn't make your point.

It's moot anyway. We surrendered without even a whimper. But we didn't have that most certain injunction imposed. Whew!!! What a relief.
