If you want to see how the Court would most likely treat the evidence Delta would use to establish that we were the cause of their cancelled flights, take a look at page 31. Finally, take a look at the duty the Court feels the RLA imposes on ALPA. (page 63). Read the case law, which you asked for, that I presented. You will see that I didn't make your point. It's moot anyway. We surrendered without even a whimper. But we didn't have that most certain injunction imposed. Whew!!! What a relief. |
