No. The repayment contract says with or without a cause, or something to that effect.
Only if you die, you don't have to pay it back.

No. They have been opening their window multiple times per year and have 777F’s coming now.

Can't believe they canned those guys. Sad really and I hope they get their jobs back. Perhaps I just don't fully understand the situation (I saw the radar and ATC recording) but these guys clearly made a mistake. It could have caused a big mess but it didn't. If they filed an ASAP and were honest about what happened, why/how could they be fired especially with the union behind them?

The ASAP program loses its teeth when it is a non sole sourced event. I’m sure ALPA is going to go to bat for the captain, but the f/o was in probation, there is nothing that ALPA can do. Hopefully he lawyers up. I can’t inagine he’d want to come back after the way the company has treated him.

What does this mean? Are you telling me that if both pilots file an ASAP about the same event neither are protected? That would seem counterintuitive, as well as counterproductive given the goals of the program.

ASAP is strongest when you and the other pilot are the sole source of the information, meaning you got it on record first. If ATC, the media and company are all aware of the incident prior to you filling it out it really becomes much less potent.

The idea behind it is to grant immunity for coming clean on things that have gone unnoticed so that the system can be objectively examined and improved.

A TCAS/RA requires a pipeline in addition to an ASAP if you filed one.

Are you say after this event, these 2 did not fill out an ASAP until they got wind people knew? I hope that's not correct, hell I would have had that ready to send immediately on landing. But, if they filled it out and the company still went in attack mode, then that's crap. These type of events are perfect for ASAP. As far as sole source and dual source it really doesn't change the event, if the pilots report it correctly and honestly, another source reporting does not take the teeth out of it.
