from the June 18th update: The arbitrator is now working with the parties to schedule additional dates for rebuttal testimony after which the hearing record will be closed and post-hearing briefs will be submitted per a schedule set by the arbitrator.

Ironically, it sets an even worse precedent if the arbitrator sides with Jetblue/NEA and against ALPA. Such a ruling would set the precedent that the scope section of an airline CBA can be flagrantly violated by any company as long as it is in the company’s best interests. It essentially guts the scope section of every airline contract.
You’d think ALPA would be pushing harder than it sounds.
This isn’t even a gray area of Section 1. The company is on record saying the scope section needed modifications (LOA13) to make the NEA legal. Then they said they were going ahead with NEA even if we didn’t give them scope concessions. It’s a documented confession of wrongdoing before and after the fact. No way the arbitrator sides with Jetblue in a fair decision.

Only when your 6pm ATL EWR BOS needs a FADEC component that will arrive on the 11pm flight from FLL. Your new scheduled departure time is 1145pm. Since you showed at 515pm, you’re good for 12 hours (contractually downgraded from 14 because your flight touches the 1-5am window of circadian low). So you eventually land in BOS at 447am. Luckily you have a commute that leaves at 6am😀😀😀, so you walk over, check in, and collapse in agony.
Normally, 190 flights are scheduled in before 1am. Then there’s SYR in the winter... the 1am becomes 3am in blinding snow and 40 knot winds. Or, the midnight diversion from BUF to ROC. Repeat after me, “ Chicken wings, and Garbage plate. Chicken wings and Garbage plate...”

We haven’t seen them since covid. It’s always the first thing I look for in the bid packet. Even before they were only seasonal. Nov dec and summer.
