I think that the intent of that clause is clear. It may take 2-3 years for a court to decide in favor of the pilots at F9, but it's tough to argue that you can merge the important assets into WN and argue that it's not covered by (A).

Lets just all hope that if Southwest does bid for Frontier, that they actually merge the two lists, rather than run two separate airlines. If this happens, I would say it is a good deal for all involved.
If they keep Southwest and Frontier, it will be bad for all involved. They will wipsaw one against the other (Look how much lower Frontier pilots are paid than Southwest pilots), probably slowing sucking routes/gates away from Frontier, and it would just be a disaster.

SWA gave ATA pilots pref. interviews, for furloughees, for 6 mos. When the "offer" ended, about 50 were interviewed and about 8 were hired. Many left ATA for SWA in the intervening years. Many more, myself included, tried to get on with SWA, but failed. CAL hired as many ex-ATA pilots as SWA, and according to AirlineApps, continues to list ATA as an "affiliation." I presume this is due to the fact that CAL is putting some ex-ATA 757-300s online. Yeah, I know. No one's hiring.

Speculate all you'd like. I'm done until we see what the final wording of the SWA proposal will be, then I'll get back involved with it.

According to the article I read, Southwest will operate Frontier seperately until the Airbuses can be replaced by 737s. All Frontier pilots will become Southwest pilots. So essentially, it made it sound that each Airbus will be replaced frame for frame by a new 737. It seems to me that Frontier pilots will score big and get to work for the holy Grail of the industry, rather than the scum eating bottom feeders. Best of luck to Frontier and the southwest deal.

Im just curiuos what you think your company's intent really is here. Reps have stated they want to keep the two seperate and bring F9 employees over as positions open. Southwest may not have bid on or owned ATA, but the pref interview is probably going to go down in the same manner.

Thanks for the link. While I'm no lawyer and certainly not a law maker (and I didn't even stay at a Holiday Inn Express last night), I think this is the key line:
(4) COVERED TRANSACTION- The term `covered transaction' means--
(A) a transaction for the combination of multiple air carriers into a single air carrier. . .
The statement made by SWA EVP Ron Ricks the other day was this:
"Frontier would continue to operate independently and separately for a period of time with its Airbus aircraft and personnel. Over time, Frontier Employees would be hired into Southwest as needed to support our fleet growth and expanded operations."
How do you see that as fitting "multiple air carriers into a single air carrier."? As I stated yesterday I'm sure the lawyers were very careful with how that was worded.
Even the "transfer of 50% of the assets" comments doesn't help here because F9 will still own the assets.
I've seen other posts saying that SWA wants some form of a labor agreement before they finalize their bid. It will be interresting to see what that is and if SWA takes a different position on how F9 employees will be "hired into Southwest".

In this day and age of the increasingly degrading airline career, it's actually good to see a pilot group get a win. Good luck F9.
