I think many of us are expecting to have not much of a choice. USAPA will try and overstep with the seniority and there will be no choice but to sue. Hope I am wrong, but there is a history of abuse. You seem to be level headed and sincere, but I fear that may not be the case for the people calling the shots.

Let me ask you a couple of questions, if you don't mind. I have a west friend that I'm not currently speaking to, or I'd ask him. He had this theory that if one guy was harmed by something other than the Nic, then it was a slam dunk DFR. I never agreed and Silver confirmed that was a mistaken thought in her ruling. Was that a widely held thought over there?
What would you consider "overstepping"?

You know what 70? Nevermind, it doesn't matter. You guys have to do what you think you need to. I don't understand the thinking on some of these issues, and the continuation of the AOL following, but I don't have to. I'd just like to see the distraction come to an end.

I agree except I don't think that the company cares about the East or the West. They were only interested in their own liability- which I think is where we agree. Where we differ is on our opinion on what Silver's ruling means. I am no attorney and I can only read the ruling and form an opinion on what it means. That said, I think the company is off the hook and given the fact that they could not care less about any other aspect of the dispute, I suspect that the company has all it needs now. In my ever so humble opinion, this ruling closed the door on the Nic. But I don't rule out Zombie Nic. I truly wish that there was a way to make you(the royal you) happy or at least content - short of the Nic. Again, in my opinion the Nic is dead and what is left standing are two pilot groups, shattered by unrestrained deregulation, bankruptcy laws and corporate plunderers. The debate about who we are, where we came from and what we deserve has always been framed in the wrong way. It has been framed in a way that puts pilot against pilot rather than pilot against management. I stand here today with my hand out- I don't want you to feel like your fellow pilots screwed you. I want a fair and just agreement. If your only reply to me is ''binding is binding- the Nic is the only way" then I suppose there is nothing left to say.
It's a free country.

That's interesting that you threw in the safety card on this. There have been zero west tail strikes since the merger. There have been zero west aircraft damaged by hitting another aircraft or running off the taxiway trying to beat another aircraft to the gate (BDL). The preponderance of incidents and procedure violations have not been on the west. We have remained focused and professional. We did not have the CIRP people activated when Silver ruled, unlike your side after the Nicolau came out. So if you are throwing crap out there you need to clean up your own mess first.
You guys must hate it that we are united and focused. There still is nothing out there that replaces the Nicolau. Until that time comes we will defend the award, that is the stated goal of AOL, defending the Nicolau and ensuring that the west pilots are represented in court. We are not rolling over now. There is still a SLI to get through and no confidence that USAPA is capable of handling that. As someone here said, "those idiots can't even get an iPad LOA done, how do you expect them to do a seniority list?"

I wasn't throwing stones, unlike you. I realized that my frustration with cacti was spilling over to all west pilots and most didn't deserve it. I was trying to ratchet down the rhetoric after asking questions and providing a warning to ALL of us to not let it lead to real problems.
AOL has clearly been WRONG on many points. It would be nice to see an admission. You want to keep believing the bs and feeding the fight, have at it. But like the east in the past, you guys are ignoring the facts.
Ps You're very wrong about no damage from the west side.

Other than the jetway incident in LAS where the chocks in signal was missed and the plane rolled into the jetway I can't think of one incident.
But fine, if you want to lump us together that's ok. We will be doing the same thing we have always done, fly safely no matter what BS is put out there.
I'm not glossing over anything, nor am I a blind follower, unlike most of your compatriots (not you, you have actually read the documents). But as you can see, these cases turn on very small points, and Judge Silver has made it very clear that she believes the west pilots have had a very legitimate case. Many of us thought we had a ripe case, even the Judge thought as well. But 10h and her interpretation of the MB process has served only to further delay the finality of the ast/west SLI. Now it may be left up to the APA merger policy and a board of arbitration. Or not, her idea that arbitration may be unnecessary after USAPA is gone is very problematic.
We may all be joining in one more trip to the Ninth to clarify her ruling. She did not listen to Siegel, the company lawyer, who is a recognized expert on RLA law and she has chosen to do her own reading of McCaskille Bond. This delays the end game and has everyone scratching their heads, while the east continues to capture upgrades and attrition with the virtual now going on 8 year fence.
So when you believe that the west pilots should just fold our hands and call it a day you could not be more wrong. No one could have foreseen the turn of events, no one would ever have believed that an agreed arbitration would have been circumvented. We have had a win and several close losses on rulings. Until this is dead and buried with a final seniority list there is no way we will stop advocating for a SLI that does not harm us.
