Its not in the contract. Its federal labor law. Comes from Supreme Court interpretations of the RLA and the NLRA. Terms of retirement and pensions, healthcare, etc. are all "mandatory subjects of bargaining". Once there is a collective bargaining agreement in place then the company is prohibited from offering different terms to any individual member than what is in the agreement. Individual contracts are illegal. If they want to change any aspect of the "wages, benefits or working conditions" covering any member of the bargaining unit then they have to go through ALPA and the RLA process. There was an interesting case on that very subject right here at Delta. 20 years ago a group of Delta pilots voluntarily took 5% pay cuts to help Ron Allen save the company. They thought ALPA should do more to support "Leadership 7.5" Management accepted their offer and cut their pay. ALPA sued and won. Those guys could not work for less than the contract rate of pay. They could donate their entire check to Ron Allen if they wanted to, but Delta first had to pay it to them. |
