I was on LC today and was passed for a GS. I thought that 23.O.12 would apply, but ALPA tells me that is a carry-over relic of the contract that was not properly updated when FAR 117 was published. According to ALPA the only GS a LC pilot can get under that provision is one that reports between 10 and 12 hours from the assignment. He sounded very confident in his answer but it's most definitely not what the contract states. Can anybody verify that FAR117 has a provision that trumps this part of the contract?

Two things here. One the coverage ladder does not apply for a delayed flight. It applies during the award process as the rotation was originally constructed.
On the GS award the contract never trumps the FAR’s. FAR’s take precedence.

Didn't know his flight was delayed at the time I replied. Also aware that the FARs would always take precedence over the contract, just felt odd that such an obvious oversight was still in the contract if it indeed violates 117.

Edit: I️ looked back, in this particular case for me, I️ was coming off an X day, so I️ was ‘in rest’ prior to the award.

If you are on x days it doesn’t matter, since you are at rest. You can take any assignment.

The confusing part is the reference to a GS given to a LC reserve with less than 12 hours notice. There are limited number of circumstances where that’s still legal under 117.

FAR’s change as well as their interpretation. Why remove a item beneficial to us and have to renegotiate it if the FAR does change. In addition FAR’s apply to every aspect of the contract. It would be 2000 pages long if we wrote the applicable FAR’s into every item they concern. A standard WS has numerous FAR’s that come into play as a example.

Usually you are at rest when the award is made if doing rolling thunder.

Yes, they can do that. It’s a delayed flight. If it arrives back after 2AM you are due a additional 5:15 for the trip. Yo may also be due compensation for the violated X day. I am sure some of the reserves on here can provide more detail.

Should anyone else need it, I found the contractual reference for how the X days are handled. It's Section 23 S. 12.

I don't think I get any extra pay other than the extra 5:15 towards reserve guarantee for blocking in after 0130 and being released after 0200.

EDIT: What's the best way to contact DALPA regarding a scheduling question? Phone call, email directly to the scheduling guys, or Submit a Scheduling Issue template on the MEC website?

They are very good about returning phone calls. They've been very busy this week with the ATL evening thunderstorms, but they usually get back to you day-of.
