maybe the union will get lucky and he didn't disclose his DUI. "congrats you got your job back, now you are fired for lying about a DUI"

I think the FAA would get involved in that case. Can't get his job back if his medical and/or license is revoked. Could even face prosecution.

He should be “convinced” to NOT pursue getting his job back through the grievance process.

He will LOSE and the union knows it. Whether he has the intellectual honesty to reach the same conclusion is the only real question. Given his behavior in the video and behind the wheel in the past, I doubt he is smart enough to realize the jig is up.

Unions can refuse to defend the indefensible. I have seen it happen first hand. The employee can threaten to sue (or actually do so) but it does not change the fact that unions can recommend that the employee resigns or does not fight the termination.

Not at NJA, right behind the NDA you sign on day one is a another paper you sign saying that you can be fired for anything that basically embarrasses or disparages the company! Also lays out in the company hand book the non-tolerance of racial, sexual orientation, and religious intolerance.

As offensive and inappropriate as the footage is, is what the former NJA pilot did even illegal? Did he commit a crime? For all we know he could have been under the influence (again) when he was recorded.

Compared to what NJASAP allegedly did (mail fraud, harassment) regarding the FlexJet union decert, why would a union member not be given full representation while the union can defend it's own immoral/illegal behavior no questions asked?

Such is NJA. Harassment is part of the culture, harassment is encouraged and tolerated at times.

It's a shame too, there is no doubt in my mind NJA can be the best job in the industry, but the culture is dysfunctional and toxic.

What happened in Chicago is not surprising. Such behavior is tolerated from the top down, whether it be management or the pilot group.

Saying offensive words isn't a crime. It might make the guy an intolerable human being but he's free to say what he wants on his time and his dime. He can be abusive to his kids, his wife, and an A hole to his neighbors too but that isn't justification for termination. He has the right to be a racist, a homophobe, a Democrat, a MAGA hat, Klan, or Antifa. But until he commits an actual crime, and being a racist A hole isn't one, then NJA doesn't have legal grounds (even if the social media crowd is triggered) to fire the guy.

And that applies to time away from work while not in uniform in your own vehicle? This sounds more encompassing than the UCMJ.

Although you may believe it should be that way it is not. Even at the major airline level. I have been told of a few specific cases.
