Well......there's two questions here that need to be answered. One, will the shareholders vote yes on the F9 deal. I think the answer is no. The other question is, will B6 be able to tender 50+1% of the shares to be able to follow through with their hostile takeover bid. I think that's a steeper hill to climb.

If the F9 deal passes, or if it doesn't pass but NK BOD decide not to accept the B6 offer and stay independent instead, then I'll agree with you. If B6 gets the required shares to effect the hostile takeover or if NK BOD accepts B6 offer after the F9 offer gets rejected, then I don't think there will be any lawsuits.

The fact that they release this offer as an after hours press release on a Friday doesn’t project confidence.

Worst part is NK gives up yet another BOD seat so not sure how this is a gain. Convinced Ted would sell his first born for that payout.
