Yes, and then "connect the dots" (as ACL likes to say) and look at today's email from ALPA touting the indispensable value of ALPA National's services and advice for our upcoming negotiations. Like I said over on the other thread... doesn't give me any "warm and fuzzies" about the road we're going down toward these negotiations.

The conflict of interest within ALPA is beyond illegal. It is disgusting.

This arrangement with APA is going to end up costing all of us millions of dollars when Eagle sues ALPA for violating their duty of fair representation.

The one thing that comes to mind is that ALPA has partially "spun off" the professional lawyer branch of ALPA... Its now a "subsidiary company" called the ISPC, or International Pilot Services Corporation.

The ability of this business to operate outside the direct control of ALPA is what I think (just an opinion/guess) will prevent a DFR lawsuit to have merit. Any lawyers have better precedent/information?

That is exactly correct. And to further support this, Moak's article in ALPA magazine specifically states that ALPA national's highest priority is to use its resources to ensure that collective bargaining agreements are in the best interests of the profession. Obviously, what is in the best interests of the profession will be decided by ALPA national/Moak.

It cannot. Not as long as the desire of major pilots are that we stop outsourcing to the regionals and JV's.

ALPA national will never do that. What they will do is remain nearly silent and extremely vague with regard to Scope. We will see a TA that keeps Scope the same at best, and gives up additional 76 plus seaters for pay raises and no-furlough clauses at worst. Then our local leadership will say "If you don't vote YES for this now, we will have to go back to the drawing board with new negotiators and who knows how long that will take." It will be at that point that you will have your proof that ALPA/DALPA cannot improve Scope for the majors.

The DFR lawsuit will not be against the subsidiary, it will be against ALPA national. It will not be a defense for ALPA to say: "It wasn't us...it was the subsidiary we used to negotiate." That defense would not have a legal leg to stand upon. Especially given the amount of written material showing ALPA bragging about APA using the professional services and expertise of ALPA.
