keep it simple, if you can drink legally your off duty, if cannot drink legally then your on duty.

117.25 that you posted states 10 hours min immediately before any reserve or duty period. So say on my day off I get up at 6am start my day off with getting the kid breakfast, then taking to school, and then run errands or work on projects around the house. Maybe take my wife to lunch. In the afternoon same stuff errands running around doing normal day off stuff. Maybe even take the boat out for a couple hours at the lake. Walk into my home at 4pm after a busy day. Crew Services call and wants to junior assign me a trip that has a 6pm show. Where in the previous 12 hours did I have the Required rest. Another, what if I like to stay up late off today suppose to be off tomorrow so go to bed at 1am company calls at 5am to junior me to a 7am show. Where is my 8 hours of opportunity. How can I ever even plan and have the rest required if I did not expect the flight. Just because I am off it does not mean I have been resting.

Btw this issue could be solved if there was a way to voluntarily pick up open time for premium pay without being "involuntarily" called for a JA. Even if the company didn't want to offer premium pay for open time all the time they could post a message or flica alert stating that any open time picked up on days off for trips starting from xx/xx/14 - xx/xx/14 pays 200% or 300% or 400% etc.

A quick MOU to the cba would solve all of this. Pilots get what they want and the company gets open time covered in catastrophic situations that we all know they wouldn't staff for anyway.

If the "interpretation" was correct this should be a no brainer and a win win for both parties. Of course JA could still exist as it already does just requiring the new "interpreted" 10hrs from the phone call to show. Above MOU would also ease the situation of all the "favorites" getting all the premium pay.

My question would be what about being on duty and having 3 hours left for you legal max flight duty period and getting extended to fly a one hour leg (I know they can extend your max flight duty period by 30 minutes but in this case there is no extension to the max time) but that extension takes you into a day off which in my company is considered junior manning would something like that require any additional rest before assignment it as long as that overnight gives you more than 10 hours of rest you're ok?

Ha. Good one. Using that same "logic" though, you are forever barred from drinking in all cases except the 2 hour window in the start of a rest period. So even if you have 3 weeks off, you can only drink in those first 2 hours since all pilots are hot ready 24/7 for instant junior man report.

After your first 2 hours from being released in all circumstances, you then enter the next 8 out of 10 hour period prior prior to a theoretical assignment and you can't drink according to your line of reasoning.

This whole JA discussion revolves around one and only one thing: pilot pushing and pilots more willing to fly tired because they are too afraid to stand up to their regional fantasy schedulers. IAW 117 flying tired/fatigued is a violation of the FAR's as well. Better take that assignment though, because you might get in trouble if you don't. Please.
