It might have been illegal, I don't know. All I know is what Pinnacle did and what the law states. I also don't know if we were ever officially labeled as 'independent contractors' by the company.

I don't know how your Merger Committee conducted operations, but the 9E guys were on a media blackout of sorts. Neither the MEC or any LECs were given updates on the Committees "proposal". The first I learned of it as a line pilot was through the leaked 9L committee update.
Out of curiosity... I thought staple meant: #1 XJ and #1 9L guy below lowest 9E guy... How is a proposal to integrate based on status and equipment a "staple". Seems like if you are an XJ guy holding 900 CA you would benefit greatly from that?

Did you get a 1099-MISC for that payments that Pinnacle gave you while in training? If you did training this year, you wouldn't get the form until next January...

It was a category/class arrangment, and it just so happened that one of the airlines had no pilots that fit into the first two categories. I'm not saying it was the most fair proposal. Perhaps doing jet captain-prop captain-jet FO-prop FO would have been better.

This was a few years ago. I honesty don't remember what tax forms they gave us. When I get back on Tuesday I'll try to dig through my old tax returns and find out. Or maybe someone else could get their own info faster.

Well we have finally established something here. All this talk of the 9E merger guys last minute modifying the list is OPINION. Perhaps to politicize this process and gain favor with the respective "former" pilot groups?
No one liked Pinnacle's proposal for SLI. We might not have liked Mesaba or Colgan's, but the slander campaign has largely been driven by folks other than 9E pilots.
Can't we just grow up and leave the smack talk out of it? I suggest that every line pilot encourages their merger committee to start a 3 way dialog with the others so that facts can be presented between the actual important players.

Again, since you didn't seem to read my other post, the December picketing blunder happened. No rumor, no lies. The list submitted was not correct, I admitted I didn't know if it was intentional. Your leaders publically admitted to submitting an incorrect list and proceeded to blame the company. No lies, no rumors. It is public knowledge, do you need me dig it up and repost it for you? The Delta swap thing, call your merger committe chair and report back here with what you find.

This arrangement was purely economic based upon the employment drought of the 1990s that allowed airlines to bend you over anyway they wanted. Your seniority date was based upon the first day of attending class and, ironically, your probation ended 365 days after that date, NOT 1 year from the checkride.
In 2007 the company began to pay for hotels and then provide a "stipend" of $400 per week to new hires in training. You were still not an employee and a 1099-Misc was issued the following February. Ironically again, this actually grossed $28 more per month than first year pay at the 75 hour guarantee would have. Employees were liable for income tax withholding and double social security contributions because (for TY2007 at least) the company reported the income as independent contractor wages. Most pilots were unaware of this and probably did not file accordingly. Clearly, training fails the test of an independent contractor but what is a newhire going to do about it? It was the union's position that those payments violated the status quo and that the newhires, who were not employees or covered by the CBA at the time, were not entitled to them so they would not intervene.
A female 2007 hire challenged management in March 1998, was ignored, and then filed a complaint with the IRS while claiming the income as a tax exempt living expense. In 2009 Pinnacle was investigated for improper use of the independent contractor designation by the IRS. The airline argued it was a clerical mistake and that the income was in fact an exempt living expense stipend.
Welcome to the Pinnacle Family, XJ and 9L folks. All bickering aside, I think that you have no idea the profound wall of STUPID and MEAN that you will encounter in dealing with Memphis HQ. Some of these people (DW) are truly pathological in their desire to make your life needlessly miserable. Most are just lazy and dumb.

I agree. This whole train wreck thread was started about pure rumor of the xj furloughs screwing up the list, the 9E guys deliberately modifying the list, and now the xj dudes trying to screw 9e over seniority dates. Everyone has their source, but no one has the facts.
