That's not how it's going to work... There won't be any language in the Endeavor LOA regarding scope. The LOA will just be a flow up/down between Endeavor and Delta. Delta is saying that will satisfy the original LOA 9 agreement and continue flying the 35 RJ's.
The reason it might be voided down the line is if DALPA argues any flow up/down must have involved them, and a arbitrator agrees and voids it. I don't understand how that could happen, since DALPA doesn't have a say in whom Delta or Endeavor hires, or have a say in contracts between Delta and Endeavor (after all, no Delta pilot would be forced to flow down to Endeavor it's voluntary, per LOA 9).
I feel like it is more likely that the argument will be the flow doesn't satisfy LOA 9 to continue operating the 35 RJs. If the arbitratior decides that is true that will put a stop to those 35 RJs flying plus awarding damages. Or, the arbitratior sides with Delta and continues flying the 35 RJs.

Yes, but they NEED EDVALPA to get those planes back in the air. OO isn’t going to entertain a flow down, and last I checked UA and AA were shareholders of YX. Who else is Delta negotiate a flow down with? Mesa?
I’m fine trading flow up for flow down, but if Delta wants to tie it to SCOPE (LOA null and void if they lose the SCOPE case) we should at least be the beneficiaries.

But it (9E flow LOA) is tied directly to Delta winning during arbitration!!!! Communications from EDVALPA state that if the planes don’t fly, we don’t flow. Our flow is tied to SCOPE!

Yes, there is concerns about DALPA vs DAL at arbitration. But nowhere has it been stated that if the planes don’t fly, we don’t flow.

Except if that were true, flow would be being offered to all 9E pilots, to include future ones. This AIP is most certainly tied to DL getting those planes flying. That is the ONLY reason this is happening. Now, I’m not saying it’s 100% not going to happen if they don’t get the planes, but I will bet it doesn’t.

“...the parties agree that this agreement in its entirety shall be rendered void and without force of effect if the Delta/ALPA System Board of Adjustment or a court of appropriate jurisdiction does not permit Delta to operate 223 76-seat aircraft under the Delta PWA.”
